What is a collaborative divorce participation agreement?
When the whole team is on board for a collaborative divorce (husband and wife, attorneys for each, financial expert, mental health expert and any other experts necessary for resolution) an agreement is prepared which details the ground rules.
This is the agreement that binds everyone to the collaborative process and what would be enforced if one of the parties bails on the process and decides to take the divorce to court. Again, if the process doesn’t work the parties must fire their attorneys and experts if they move forward with filing for divorce. This participation agreement is how that is enforced.
There are also other important clauses throughout the participation agreement such as agreements to valuation dates, rules of contact for the parties and an explanation of the process.
