In a Florida divorce, the marital portion of a law-enforcement pension is generally subject to equitable distribution. How that portion is identified and paid depends on your plan:
- Florida Highway Patrol (FHP): Covered by the Florida Retirement System (FRS)—uses QDRO/DRO processes. MyFRS+2FRS Online+2
- Hillsborough County Sheriff’s Office (HCSO): Deputies participate in FRS, so division follows FRS rules. Hillsborough County
- City of Tampa Police Department (TPD): Members are in the Tampa Fire & Police Pension Fund, a municipal plan with its own procedures; it does not honor ERISA “QDROs” and uses court-fashioned orders consistent with Florida domestic-relations law. City of Tampa+1
Florida courts start from equitable distribution of marital assets (which include the pension benefits earned during the marriage) and may adjust based on statutory factors. Florida Legislature+1
This article is information, not legal advice. Speak to a Florida family-law attorney who regularly drafts pension orders for public plans.
Florida basics: “marital portion” and equitable distribution
Florida law treats vested and non-vested retirement benefits accrued during the marriage as marital assets. Courts begin with an equal division and adjust as equity requires. Typically, the marital share is calculated using a coverture fraction: years of service during marriage ÷ total years of service, multiplied by the benefit, with the court then allocating that marital portion between spouses. For public safety employees, two other features often matter:
- Survivor/joint-annuitant elections (affecting how a monthly benefit continues to a survivor); and
- DROP (Deferred Retirement Option Program) accumulations, where offered, which may be divided or offset per plan rules and court order. FRS Online
Florida Highway Patrol (FRS – Special Risk Class)
FHP troopers are state employees in the FRS Pension Plan (defined benefit) or FRS Investment Plan (defined contribution). Both are administered under state law with specific divorce procedures. MyFRS+1
How division works (FRS Pension Plan)
- The Division of Retirement recognizes Pension Plan QDROs/DROs drafted to FRS specifications. The state publishes instructions and even model orders, including for DROP benefits, to ensure compliance. Payments to a former spouse (the “alternate payee”) are made directly pursuant to an approved order. Florida DMS+1
- The FRS guidance explains how the marital share is typically derived and emphasizes that orders must be pre-approved by the Division before filing, to avoid rejection. FRS Online
How division works (FRS Investment Plan)
- The Investment Plan requires a QDRO that meets statutory criteria. The plan’s administrator (Alight) qualifies the order before any split or distribution. MyFRS+1
DROP considerations for FHP
If you elect FRS DROP, your accumulated DROP account can be addressed in the order. Model orders outline how an alternate payee’s share accrues interest and when it is released (generally at the end of DROP participation). FRS Online+1
Bottom line for FHP: Expect direct division through a compliant FRS pension/investment order. Coordinate survivor elections, cost-of-living adjustments where applicable, and DROP language carefully in the order. MyFRS+1
Hillsborough County Sheriff’s Office (HCSO)
Hillsborough County employees—including the Sheriff’s Office—participate in the Florida Retirement System with a choice of the Pension or Investment Plan. Therefore, divorce division tracks the same FRS rules described above. Hillsborough County
Practical notes for deputies:
- Verify which plan you’re in (Pension vs. Investment) and whether you’ve elected DROP. Your MyFRS portal and the Division can confirm status and service history. MyFRS+1
- Work with counsel to draft/submit an FRS-compliant order (and pre-clear it with the Division/administrator) so payments can be made directly to the alternate payee. Florida DMS+1
City of Tampa Police Department
City of Tampa police officers are members of the City Pension Fund for Firefighters & Police Officers (commonly, Tampa Fire & Police Pension). This is not the FRS; it’s a municipal plan with its own policies. City of Tampa+1
Key differences in a Tampa PD divorce
- The plan recognizes that pension benefits may be marital property under Florida law. However, as a governmental plan, it does not honor ERISA QDROs. Instead, courts “fashion” orders under Florida domestic-relations law to ensure distribution of marital property interests. The fund can also administer income deduction orders (alternatively income withholding orders) for alimony or child support. City of Tampa
- The Fund publishes board policies (e.g., on marital separation and beneficiary issues) that counsel must follow, and it manages DROP and survivor provisions under its contract and policies. City of Tampa+1
What this means: Division for Tampa PD typically occurs via court-ordered mechanisms and/or offsets in equitable distribution, aligned with the Fund’s rules—rather than an ERISA-style QDRO. Ensure your attorney coordinates directly with the Fund administrator so the order uses permitted language and the Fund can implement it. City of Tampa
Calculating the marital share (all three)
Florida courts classify and value pension rights, then distribute the marital portion. Common practice uses:
- Coverture fraction to isolate the service earned during the marriage;
- Valuation date set by the court; and
- Adjustments for COLAs, buy-back/military time, interest in DROP, and survivor benefits to keep each party’s share actuarially fair. The Florida Bar
Because these are defined benefit pensions (for FRS Pension and Tampa’s plan), the order must specify what is being divided (monthly benefit stream, DROP balance, survivor election impacts) and how. For FRS Investment Plan accounts (defined contribution), the order typically specifies a percentage or dollar amount of the account as of a date, plus gains/losses until distribution. MyFRS+1
Survivor benefits and beneficiary designations
Survivor or joint-annuitant elections can materially change value. Many orders require the employee-spouse to elect a joint & survivor option or to maintain a specified beneficiary designation for the alternate payee. Tampa’s Plan and FRS both have a possible option to administer survivor options under their own contracts; this is complicate, so your lawyer must align the divorce order with those options so the intended benefit actually pays as ordered. FRS Online+1
Timing and payment mechanics
- Direct payment: With an approved FRS order, the plan can pay the alternate payee directly. The Tampa fund follows its policies and court orders (not ERISA QDROs). Florida DMS+
- Pre-approval matters: FRS encourages pre-review of proposed orders before you submit them to court, reducing costly mistakes and delays. FRS Online
Special note on DROP
Both FRS and Tampa Fire & Police administer DROP. If the officer is (or was) in DROP, the order must say whether the alternate payee receives:
- A share of the monthly benefit as it flows into DROP;
- A share of the accumulated DROP account (with interest, if applicable); and
- When/how that share is released (e.g., at DROP termination). FRS model orders spell this out; Tampa’s fund will require order language consistent with its policies. FRS Online+1
Action steps for FHP, HCSO, and Tampa PD families
- Confirm your plan
- FHP/HCSO: Check MyFRS (Pension vs. Investment; any DROP). MyFRS
- TPD: Contact the Tampa Fire & Police Pension office for your member record and plan-specific guidance. City of Tampa
- Get the right order template
- FRS publishes QDRO/DRO instructions and model language (including DROP options). Use them and seek pre-approval. Florida DMS+1
- Tampa PD: Work through counsel to draft an order the Fund will implement (it does not honor ERISA QDROs). City of Tampa
- Model the numbers
- Ask your attorney/actuary to compute the coverture fraction, value any DROP, and test survivor election scenarios so the trade-offs are clear before settlement. (Florida courts classify/value then distribute.) The Florida Bar
- Coordinate timing
- Align the valuation date, commencement date, and any lump-sum vs. rollover choices with each plan’s rules. (General QDRO framework.) Investopedia
FAQs
Is my entire pension split in a Florida divorce?
No. Typically, only the portion earned during the marriage is considered marital and subject to equitable distribution. The court can deviate from a 50/50 split based on statutory factors. Florida Legislature
Do FRS plans accept QDROs?
Yes. The FRS Pension Plan and Investment Plan follow published QDRO/DRO procedures; use state-provided guidance and model orders. Florida DMS+1
I’m a Tampa PD officer—why can’t we just file a normal QDRO?
The Tampa Fire & Police Pension is a municipal governmental plan and does not honor ERISA QDROs. The court instead uses orders consistent with Florida law that the Fund can administer (e.g., income deduction orders, tailored provisions). Coordinate with the Fund and counsel. City of Tampa
What about DROP balances?
Both FRS and Tampa PD have DROP programs. Your order must explicitly state how DROP is divided and when the alternate payee receives their share. FRS model DROP orders are available. FRS Online
The bottom line
- FHP and HCSO pensions are governed by FRS; with a properly drafted and pre-approved order, the marital share can be paid directly to the former spouse, including DROP when applicable. Florida DMS+1
- Tampa PD pensions are under the Tampa Fire & Police Pension Fund, which follows its own divorce-order procedures (not ERISA QDROs). Plan ahead with Fund staff and an attorney who knows public safety plans. City of Tampa
- Across all three, Florida’s equitable distribution statute controls classification and division; careful drafting and plan coordination determine how benefits actually get paid. Florida Legislature
